Ireland's proximity to the UK and its large number of British nationals and cross-border workers creates a specific pension mis-selling context. Adviser firms operating in Ireland recommended transfers of UK defined benefit pension rights into SIPP and QROPS arrangements during the 2010–2022 period.

MiFID passporting arrangements mean that many EU-based adviser firms operated across Ireland without specific FCA authorisation. Where the Irish-based adviser was not FCA-authorised at time of transfer, FSMA s.27 provides a civil court remedy. UK FOS jurisdiction applies to the UK-regulated SIPP element of any transfer.
